Terms of Service
Plain-English summary (not a substitute for the full Terms): Offerant is a tool that helps you search for jobs. It does not guarantee interviews, offers, replies, or any other result. You decide what is sent and submitted in your name and you are responsible for it. Subscriptions renew monthly until you cancel. Disputes are resolved by individual arbitration, not class actions.
1. Agreement
These Terms of Service ("Terms") are a binding agreement between you and Niko Manolakos ("Offerant," "we," "us"). By creating an account, checking the box that you agree, or using the service at getofferant.com (the "Service"), you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old and able to form a binding contract.
2. What the Service does
The Service uses automated software, including artificial intelligence, to help you find job postings, score them against your preferences, tailor your resume using information you provide, prepare and (where you enable it) submit job applications, find professional contact information that is publicly published, and draft and (where you enable it) send emails from your own email account. Features, supported websites, and limits change over time.
3. No guarantee of results
Offerant does not guarantee that you will receive any interview, job offer, employment, response, referral, or other outcome. Hiring decisions are made solely by employers. Job postings may be inaccurate, outdated, filled, or withdrawn. Employers, applicant-tracking systems, and email providers may reject, filter, ignore, or flag applications and messages for reasons outside our control. Results described anywhere on our website are illustrative and not a promise. You are not entitled to any refund, credit, or damages because you did not obtain an interview, job, or response.
4. You are in control and responsible
- Your information. You are responsible for the accuracy and completeness of everything you provide, including your resume, work history, education, work authorization, and answers to application questions. The Service tailors and fills in content from what you provide; you must review it. Do not provide false or misleading information.
- What is sent and submitted. Applications and emails go out in your name, from your accounts. You are solely responsible for reviewing, approving, and the content and consequences of every application submitted and every message sent through the Service, including messages sent automatically under settings you enable.
- AI-generated content. Drafts, tailored resumes, scores, and suggestions may contain errors or omissions. They are not professional, legal, or career advice. Review them before use.
- Laws and third-party rules. You must comply with all applicable laws, including anti-spam and privacy laws (such as the U.S. CAN-SPAM Act), and with the terms of job boards, employer websites, applicant-tracking systems, and your email provider. Some websites restrict automated use; you are responsible for deciding whether to use the Service with them. We may block features or sites at any time.
- Your accounts. You authorize the Service to access the email account you connect solely to send messages you approve or enable, and to read replies to those messages. You are responsible for that account, its security, and any limits or actions your email provider applies to it.
4A. Authorization to act on your behalf
When you enable submitting or sending, you appoint Offerant as your limited agent solely to transmit the applications and messages you approve, or that your settings allow, using the accounts you connect. Offerant is not an employment agency, recruiter, or staffing service, does not represent employers, and is not a party to any application, interview, offer, or employment relationship. We do not review the legal or factual accuracy of what you submit. You may revoke this authorization at any time by pausing the agent, turning off live mode, disconnecting your accounts, or deleting your account.
4B. Account security
You are responsible for keeping your password, app passwords, and API keys confidential and for all activity under your account. Tell us at offerantsupport@gmail.com immediately if you believe your account has been accessed without permission. We may require you to change credentials or re-verify your identity to protect the Service.
5. Acceptable use
You will not use the Service to: send unsolicited bulk email or harassing, deceptive, or unlawful messages; impersonate anyone; misrepresent your qualifications; collect personal data for any purpose other than your own job search; circumvent security measures, CAPTCHAs, or verification codes; scrape or overload any website; resell or share your account; reverse-engineer the Service; or violate anyone's rights. We may suspend or terminate accounts that violate these Terms.
6. Subscriptions, billing, and cancellation
- Plans. Paid plans (currently Gold and Platinum) are billed monthly in advance through our payment processor, Stripe. Plan features and usage limits are described on our pricing page and may change with notice.
- Automatic renewal. Your subscription renews automatically each month at the then-current price, charged to your payment method, until you cancel. You authorize these recurring charges.
- Cancellation. You may cancel at any time from your account's Billing page. Cancellation takes effect at the end of the current billing period; you keep paid features until then.
- Refunds. Except where required by law, payments are non-refundable, including for partial months, unused features, or results not achieved.
- Price changes. We will give at least 14 days' notice of a price increase; it applies from your next renewal.
- Taxes and failed payments. Prices exclude applicable taxes. If a payment fails, paid features may be paused until payment succeeds.
7. Free preview
Without a paid plan the Service may operate in preview mode, in which nothing is sent or submitted. Preview features may change or end at any time.
8. Third-party services
The Service works with third-party websites and services (for example job boards, applicant-tracking systems, email providers, Stripe, and optional providers you connect). We do not control them and are not responsible for their availability, content, decisions, or actions. Your use of them is governed by their own terms.
9. Your content and data
You keep ownership of the content you provide. You grant us a limited license to host, process, and transmit it solely to operate and improve the Service for you, as described in the Privacy Policy. You may delete your account and data at any time from your Account page.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL PRODUCE ANY PARTICULAR RESULT, INCLUDING INTERVIEWS OR EMPLOYMENT.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OFFERANT AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST OPPORTUNITIES, LOST EMPLOYMENT OR WAGES, LOST PROFITS, REPUTATIONAL HARM, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
12. Indemnification
You will defend, indemnify, and hold harmless Offerant and its owners from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, the content you provide, the applications and messages sent in your name, or your violation of these Terms, any law, or any third party's rights or terms.
13. Dispute resolution and arbitration
Please read carefully. Any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court. You and we waive any right to a jury trial and to participate in a class, collective, or representative action. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing offerantsupport@gmail.com with your name, account email, and a statement that you opt out.
14. Governing law
These Terms are governed by the laws of the state in which the operator of the Service is located, without regard to conflict-of-law rules. Subject to Section 13, the courts located in the state in which the operator of the Service is located have exclusive jurisdiction.
15. Termination
You may stop using the Service and delete your account at any time. We may suspend or end your access if you violate these Terms, if required by law, or if we discontinue the Service; if we discontinue it without cause we will refund any prepaid amount for the unused remainder of the current billing period. Sections 3, 4, 9-14 and 16 survive termination.
16. Changes and general terms
We may update these Terms. If we make material changes we will ask you to accept the new version before you continue using the Service. These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger or sale.
16A. Electronic communications and notices
You agree to receive service, billing, security, and legal notices electronically at the email address on your account; those notices satisfy any legal requirement that a communication be in writing. Marketing email is optional and you can opt out at any time.
16B. Events beyond our control
We are not liable for delays or failures caused by events outside our reasonable control, including outages of third-party websites, applicant-tracking systems, email providers, hosting or payment providers, network failures, or changes to third-party terms or technical measures that block automated access.
